Terms of Use

1. Introduction

These Terms of Use (hereinafter referred to as the "Terms") set forth the conditions for using the services (the "Services") provided on the website “Komeda Coffee Official Online Shop” (https://ec-komeda.xyz, hereinafter the "Site") operated by Belle Maison Logisco Co., Ltd. (the "Company").
By accessing or using the Site and Services, all users ("Users") are deemed to have agreed to these Terms.

2. Changes to the Terms

The Company reserves the right to revise these Terms at any time without prior notice. Unless otherwise stated, such revisions shall take effect upon being posted on the Site. Continued use of the Services following any such revisions constitutes acceptance of the revised Terms.

3. Registration

  1. Individuals wishing to use the Services by registering an account ("Applicants") may apply by agreeing to these Terms and submitting the required information ("Registration Information") as specified by the Company.

  2. The Company will review each application and, if approved, will issue an account to the Applicant.

  3. Registered Users are solely responsible for managing their login credentials. The Company shall not be liable for any unauthorized use unless due to its willful misconduct or gross negligence.

4. Use of Services

  1. Users shall comply with these Terms and any additional rules or notices provided by the Company when using the Services.

  2. Users are solely responsible for all content they transmit through the Services and must not cause harm or inconvenience to the Company.

  3. If the User is a minor, parental or guardian consent is required to use the Services.

5. Sales Contract

  1. A sales contract between the User and the Company is formed when the Company confirms the User’s order via the Site and displays an order confirmation. A confirmation email will also be sent.

  2. If order information fails to reach the Company due to system issues, no contract is formed, and the Company is not liable for any resulting damages.

  3. Upon contract formation, the Company will charge the purchase price ("Price") using the payment method selected by the User at checkout.

6. Outsourcing

The Company may outsource certain operations related to the Services to third parties. Inquiries should be directed to the following:

7. Termination of Contract by Company

The Company may cancel a sales contract at its discretion by notifying the User individually if any of the following occur:

  • Violation of these Terms

  • Inability to deliver due to incorrect address or prolonged absence

  • Failure to make payment within the specified period

  • Credit card payment is declined

  • No response to inquiries regarding purchase within two weeks

  • Delivery is impossible for reasons not attributable to the Company

  • User falls under any prohibited category under Article 12, Sections 2–6

8. Payment Methods

  1. Users may choose from the following payment options: Credit Card, Amazon Pay, PayPay, Apple Pay, or Rakuten Pay.

  2. The Company may modify available payment methods at any time.

  3. If credit authorization fails, the Company may request payment via alternative methods.

9. Shipping

  1. Users must provide a delivery address at the time of order. Products will be shipped via a designated courier and confirmed via email.

  2. For credit card payments, shipping begins after authorization is confirmed.

  3. If a missed delivery occurs, the User must arrange redelivery with the courier.

  4. Delivery may be delayed due to:

    • Temporary stock shortages

    • Incomplete or incorrect order information

    • Force majeure (e.g., natural disasters)

    • Courier delays

    • National holidays

  5. Risk and ownership transfer to the User upon handover to the courier.

  6. The Company is not liable for direct or indirect damages resulting from delays unless caused by gross negligence or willful misconduct.

For International Shipping:

  • Only eligible products are shipped internationally

  • Delivery is currently limited to Taiwan

  • DHL Japan handles shipping

  • Users must pay estimated shipping fees, import taxes, and duties at order confirmation

  • In the event of any conflict, this section shall prevail over Articles 1–6

10. Cancellations and Exchanges

  1. Returns or exchanges due to User convenience are not accepted. Cooling-off provisions do not apply.

  2. Users must inspect products upon receipt. If damage or errors are found due to the Company’s fault, the Company will provide a free replacement or request a return via cash-on-delivery.

  3. Returns or exchanges will not be accepted if the product was used, damaged by the User, or the procedures were not followed.

  4. Except as provided above, the Company bears no liability for defects in products sold via the Services.

11. Suspension or Termination of Services

The Company may, without prior notice, suspend, modify, or terminate the Services for reasons including:

  • System maintenance (scheduled or emergency)

  • Fire, power outages, or external interference

  • Force majeure events

  • Any other circumstances deemed necessary
    The Company shall not be liable for any resulting damages.

12. Account Deletion and Restrictions

The Company may, without notice, delete User accounts if any of the following apply:

  1. Violation of these Terms or other rules

  2. Subject to legal or administrative proceedings (e.g., seizure, bankruptcy)

  3. Filing for bankruptcy or civil rehabilitation

  4. Notification of voluntary debt settlement

  5. Involvement with or past affiliation to criminal organizations

  6. Any other reason the Company deems sufficient
    Users waive any right to object to such actions or claim compensation.

13. Prohibited Conduct

Users must not:

  1. Engage in illegal or immoral acts

  2. Interfere with the Site’s operations

  3. Damage the Company’s or third-party reputation

  4. Use false or third-party personal information

  5. Violate these Terms or related rules

  6. Infringe intellectual property rights

  7. Engage in any act the Company deems inappropriate
    Users shall be liable for any damages caused by violations.

14. Intellectual Property

All content on the Site (text, images, design, etc.) belongs to the Company or rightful copyright/trademark holders.
Users may not reproduce, modify, or use content beyond permitted personal use without prior written consent from the Company.

15. Personal Information

The Company (and its contractors) shall handle personal information obtained through the Services in accordance with its Privacy Policy.

16. Disclaimers

  1. The Company may modify or delete content or structure of the Site without notice and is not obligated to act on User requests.

  2. The Company does not guarantee compatibility with all User environments or devices.

  3. Users are responsible for resolving disputes with third parties arising from use of the Services.

  4. The Company is not liable for any damages unless caused by willful misconduct or gross negligence.

  5. Any translated version of these Terms is for convenience only. In case of discrepancies, the Japanese version (https://ec-komeda.xyz/policies/terms-of-service) shall prevail.

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan.
All disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Nagoya District Court in Japan.
